典型欺凌者
霸道和沖動(dòng),傾向使用暴力欺壓他人。

被動(dòng)欺凌者
看見(jiàn)欺凌者的暴力行為得逞,于是協(xié)助及附和欺凌者,有些則藉此保護(hù)自己,免受欺凌。
看見(jiàn)欺凌者欺凌同學(xué)后,則嘲笑受害者無(wú)用。
被欺凌者
性格內(nèi)向、害羞、怕事。
在同學(xué)間不受重視,只有很少朋友,在學(xué)校中十分孤單。
缺乏與同輩相處的社交技巧,容易引起同學(xué)不滿(mǎn)和反感。
有身體障礙者、有智力障礙者。
沉默、表達(dá)能力不佳者。
性格或行為上有異于他人。
對(duì)受害者影響
欺負(fù)同學(xué)會(huì)對(duì)同學(xué)構(gòu)成心理問(wèn)題,影響健康,甚至影響人格發(fā)展。
身心影響:恐懼、消沉抑郁、創(chuàng)傷后遺癥、憂慮、胃痛、吸毒、酗酒、自殘、自殺,自己也成為欺凌者,可能是校園槍擊案的原因之一。
其他影響:常常缺席、對(duì)老師不恭敬、訴訟。
校園欺凌我國(guó)現(xiàn)狀,最高法的調(diào)研報(bào)告首先說(shuō)明,校園暴力在我國(guó)時(shí)有發(fā)生,但是情況復(fù)雜,違法與犯罪交織,且多數(shù)事件未進(jìn)入司法程序追究法律責(zé)任,加上目前缺少統(tǒng)一的事件報(bào)告、統(tǒng)計(jì)制度,導(dǎo)致難以了解我國(guó)校園暴力發(fā)生的真實(shí)情況。去年5月,最高人民法院從2013-2015年各級(jí)法院審結(jié)生效的校園暴力刑事案件中抽取100多件典型案件樣本進(jìn)行了梳理,在一定程度上反映出此類(lèi)犯罪的特點(diǎn),最高法刑一庭審判長(zhǎng)冉容介紹,校園暴力犯罪案件涉及的罪名相對(duì)集中。針對(duì)人身的暴力傷害比例最高,其中,故意傷害罪占57%,故意殺人罪占6%。
校園暴力涉及的罪名還包括尋釁滋事罪占10%;侵財(cái)犯罪占12%,還有很小比例的聚眾斗毆罪與綁架罪。
報(bào)告統(tǒng)計(jì)數(shù)據(jù)顯示,抽查樣本涉及的159名未成年被告人中,已滿(mǎn)十四不滿(mǎn)十六周歲的被告人占 35%;已滿(mǎn)十六不滿(mǎn)十八周歲的被告人占65%。
冉容介紹,雖然我國(guó)規(guī)定,十四歲是可以承擔(dān)刑事責(zé)任的年齡,但是,已滿(mǎn)十四周歲不滿(mǎn)十六周歲的被告人只對(duì)八類(lèi)嚴(yán)重暴力犯罪承擔(dān)刑事責(zé)任,所以,未滿(mǎn)十六周歲的放在比較輕微的校園暴力行為,沒(méi)有進(jìn)入我們刑事犯罪處罰的程序,所以相對(duì)來(lái)看,這一百多件案件中,處罰的高中生及職業(yè)高中的未成年被告人占比較高。
